Terms of Service

The terms that govern your use of deltatkc.com and the services Delta T Heating & Cooling provides.

These Terms of Service (the “Terms”) form a binding agreement between you and Delta T Heating & Cooling, a Kansas business operating at 1950 N 142nd Street, Basehor, KS 66007 (“Delta T Heating & Cooling,” “we,” “us,” or “our”). They govern your use of the website at deltatkc.com (the “Site”) and any related content, forms, and tools we make available through it (the “Services”).

By using the Site, you accept these Terms. If you do not accept them, please do not use the Site. Effective June 22, 2026.

1. Eligibility and accounts

You must be at least eighteen (18) years old, or the age of legal majority in your jurisdiction, to use the Site or to request service from us. By using the Site you represent that you meet that age requirement and have the legal capacity to enter into these Terms.

2. The Services

Through the Site you can read about our HVAC, plumbing, indoor-air-quality, and related home-services offerings; request a service appointment or a free second opinion on a quote you received elsewhere; sign up for a maintenance plan; and apply for financing through our partner. The actual provision of services in your home or business is governed by a separate written service agreement that we will give you before any work begins.

3. Estimates, quotes, and AI-assisted content

Estimates and quotes are non-binding. Any price, scope of work, completion timeline, equipment recommendation, or rebate amount that appears on this Site, in an automated tool, in an AI-assisted reply, in a marketing email, or in a phone call is an estimate provided for your convenience. It is not a contract and it is not a guarantee. The amount you actually pay and the work we actually perform is the amount and scope written into a signed service agreement between you and Delta T Heating & Cooling before the work begins.

We use AI tools to help us draft educational content on this Site, to triage incoming questions, and to summarize call recordings. AI-generated content is reviewed by a human before publication, but AI tools can make mistakes; nothing AI-generated on this Site constitutes professional engineering, legal, accounting, medical, or other professional advice. For any project-specific recommendation, we will provide a written assessment from a licensed professional engineer or licensed technician.

4. Acceptable use and license to the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use of evaluating and engaging our Services. You agree not to:

  • Copy, reproduce, scrape, mirror, frame, sell, or commercially exploit the Site or its content without our prior written permission.
  • Use the Site or our Services to harass, defame, threaten, stalk, or harm any person.
  • Submit false information through any form, attempt to impersonate another person, or interfere with the security or operation of the Site.
  • Reverse-engineer, decompile, or attempt to derive source code from any part of the Site.
  • Use any automated means (robots, spiders, scrapers) to access the Site, except as permitted by our /robots.txt file.

5. Intellectual property

The Site and its content — including the Delta T Heating & Cooling name and logo, all text, photographs of our team and trucks, page designs, illustrations, and selection and arrangement of materials — are owned by or licensed to Delta T Heating & Cooling and are protected by copyright, trademark, and other intellectual-property laws. Brand names used on the Site (for example, Lennox, Bosch, iWave, NATE, EPA) belong to their respective owners and are used here solely to indicate compatibility, dealer status, or certification.

6. Your submissions

When you submit information through a form, a review, a photo upload, or any other means, you grant Delta T Heating & Cooling a worldwide, royalty-free, non-exclusive license to use, store, copy, modify, and display that submission in connection with operating the Services and the Site. You represent that the submission is yours to give, that it does not violate any third party's rights, and that it is accurate to your knowledge. We may remove any submission at our discretion.

7. Disclaimer of warranties

The site and the services are provided “as is” and “as available.”

To the fullest extent permitted by applicable law, Delta T Heating & Cooling and its affiliates, officers, employees, and contractors disclaim all warranties, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, or uninterrupted availability. We do not warrant that the Site will be error-free, that defects will be corrected, or that any information on the Site is current.

Any warranty applicable to physical work we perform at your home or business is the warranty written into the signed service agreement for that work — not a warranty of the Site or its content.

8. Limitation of liability

To the fullest extent permitted by law:

  • Delta T Heating & Cooling will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or loss of goodwill, arising from or related to your use of the Site, regardless of the theory of liability and even if we have been advised of the possibility of such damages.
  • Our total aggregate liability arising from or related to your use of the Site (as distinct from the physical service work we perform under a separate signed agreement) shall not exceed the greater of (i) the amount you paid to us for the Site-related transaction giving rise to the claim, or (ii) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you. Nothing in this Section limits our liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded by law.

9. Indemnification

You will defend, indemnify, and hold harmless Delta T Heating & Cooling and its affiliates, officers, directors, employees, contractors, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from or related to (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any third party's rights, or (d) any submission you provide through the Site.

10. Third-party services

The Site contains links to third-party websites and integrations with third-party services (for example, Service Finance Company for financing, Google Maps for the service-area display, our payment processor, and our call-tracking provider). Your use of those third-party services is governed by their own terms and privacy policies, and Delta T Heating & Cooling is not responsible for their content or practices.

11. Binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site (a “Dispute”) — other than (a) a small- claims-court matter that qualifies as such, (b) an intellectual-property infringement claim, or (c) a request for emergency injunctive relief — shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Leavenworth County, Kansas (or by remote means if permitted by the AAA Rules), and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

Class-action waiver. You and Delta T Heating & Cooling agree to bring any Dispute solely on an individual basis. You and we waive any right to participate in a class action, class arbitration, or representative-action proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice within thirty (30) days of first accepting these Terms to [email protected] with the subject line “Arbitration Opt-Out.” The notice must include your name, mailing address, and a statement that you do not wish to resolve disputes through arbitration. Opting out will not affect any other provision of these Terms.

If for any reason this arbitration provision is held unenforceable, the Disputes shall be resolved by the state or federal courts located in Leavenworth County, Kansas, and you consent to the personal jurisdiction of those courts.

12. Governing law, severability, entire agreement

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws principles. If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or struck to the minimum extent necessary, and the remainder shall remain in full force.

These Terms (together with our Privacy Policy, including its Your Privacy Choices section, and any signed service agreement) are the entire agreement between you and Delta T Heating & Cooling regarding the Site, and they supersede any prior agreements on the same subject matter. Our failure to enforce a right is not a waiver of that right.

13. Changes and contact

We may update these Terms from time to time. The “last updated” date at the bottom of this page reflects the most recent revision. By continuing to use the Site after a material change, you accept the updated Terms.
